Introduction

Please read these Terms of Use (“Terms”, “Terms of Use”) carefully before using www.homeinspire.co.uk website (the “Service”) operated by HomeInspireUK Ltd (“us”, “we”, or “our”).

The Site is a site operated by HomeInspireUK LTD (“We”). We are registered in England and Wales under company number 13283996 and have our registered office at International House, 24 Holborn Viaduct, London, EC1A 2BN.

Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service.

Our Privacy Policy which sets out the terms on which we process any personal data we collect from you, or that you provide to us. By using our Site, you consent to such processing and you warrant that all data provided by you is accurate.

Our Service to you

These terms set out the conditions on which we advertise UK Professional Businesses that provide products/services in the home & construction industry. Both Customers and Businesses are bound by these terms which govern how you use HomeInspire and how you interact with Professionals.

Our Role

HomeInspire is a website, as well as social media pages on which we primarily market UK Professionals and Businesses that provide products/services in the home & construction industry. The website is set up so Professionals and Businesses can use the site to market their products or services. We also provide advice and various articles, written by us and other businesses’ on the site. We are not liable for any outdated or incorrect information provided in any of these.

For the business listings, professionals are asked to upload information about their profile and credentials. Although we ask our Professionals to warrant that the information they have supplied as part of their registration process is accurate and that they will notify us of any changes, we do not verify this information. HomeInspire shall not be liable if any such information is inaccurate or outdated. However, our aim is to provide reliable and accurate data from trusted Professional, so if you establish that any information provided by a Professional about their background or credentials is inaccurate or outdated, please email us at info@homeinspire.co.uk

Use of our platform

Customers do not need an account to search for Professionals which offer your required services or products. Professional profiles will state their details including location, services offered, specialties, average projects costs, and any photos of work they have carried out (if applicable). You agree that any decisions you make on the basis of this information, is your sole responsibility. Some of the businesses also offer cashback. We will highlight how much cashback is available on that business, the percentage and also the terms and conditions of that cashback on the businesses’ profile. Customers do not however require an account to submit a cashback form. Thes cashback form can be found here.

Disclaimer

Your use of the Service is at your sole risk. The Service is provided on an “AS IS” and “AS AVAILABLE” basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement or course of performance.

How does the cashback process work?

We offer cashback on various businesses on our website, with the amount and terms stated on their business listing. It is recommended that the customer contacts the business through the contact form on the business listing, to help us track the cashback. This however isn’t compulsory, but cashback may take longer to be paid. Once the customer has completed the purchase, they will need to complete a cashback form to apply for cashback. Once we receive this, we’ll invoice that business for the commission that has been agreed between the two parties. Once we receive our commission then we’ll pass on the majority of this back to the customer in the form of cashback. We take a small, set fee to cover advertising and other costs.

When the customer uses a business advertised on our website, we are in effect, acting as an advertising agent for that business by sending them customers & traffic. When a business signs up and chooses our Affiliate marketing plan, they agree to our Affiliate Agreement, agreeing to pay us commission everytime they get a completed job through our advertising. It’s from that commission that the cashback is paid back to the customer.

Earning Cashback

Customers

The purchase must be a genuine purchase. Repeat purchases may qualify for Cashback, depending on the business. If they do, they must be purchased for genuine reasons. By making a transaction with a Professional through our website you acknowledge that it is at the Professional’s entire discretion to determine whether a transaction is genuine and you acknowledge that we will not be liable for any unpaid Cashback where a retailer has deemed a transaction disingenuous.

Cashback may be declined if all or part of your order is returned, exchanged, amended or cancelled. When you submit your cashback form, we will then issue an invoice to the Professional for our commission. We then ask this to be settled within 30 days of this invoice, and once settled we pay you your cashback. This is through BACS, via bank details that you submit via the cashback request form.

(BACS stands for “Banks Automated Clearing System” or perhaps “Bankers Automated Clearing Services”. This is the system used by banks to allow people to pay bills or transfer money directly from their bank account to another bank account. We make use of this system to pay your cashback directly into your bank account).

Please allow BACS payments 1 working day (please allow 3 working days after request to show in your bank account). Estimated Payable dates however are purely for guidance only and are not a guaranteed date for the receipt of the funds. Where the estimated payable date for the commission on a transaction has surpassed and/or the progression is delayed, we will not be liable to pay the relevant cashback to you.

In the event that your product purchased can be refunded, we ask Professionals to only pay commission after the returns period (if applicable) on your purchase. This is to avoid any incorrect payments in commission and cashback, and to avoid the customer being paid cashback and returning the product and getting a full refund. We are therefore restricted by the Professional’s return period before paying you your cashback. We shall not be held liable for any late cashback to yourself. Should you return your product after you’ve submitted your cashback form, the Professional will reject our commission invoice for this reason, and we will decline your cashback request which will show in your account.

If you notify us that a cashback payment has not been received, we will use reasonable endeavours to investigate such Claim with the Professional, subject always to our right to cease investigations at any point at our entire discretion. You can do this by completing our contact form.

You acknowledge that it’s the Professional’s decision is final in relation to the payment of commission to us and in turn, our decision is final in relation to paying Cashback to you. We will make all reasonable endeavors to secure the payment of commission on a transaction but we do not and cannot make any guarantee in this regard. In the event we do not receive the expected commission for a transaction for whatever reason, we will not be liable to pay the relevant Cashback to you.

We do reserve the right to reclaim or adjust any Cashback payments in the event that any Cashback has been paid to you in error. This may include but not be limited to transactions where Cashback is not genuinely due to you or where any commission for a transaction has not been received from the Professional but been paid over to you as Cashback in error.

For the avoidance of doubt and notwithstanding any other provision contained in these terms and conditions, you agree and acknowledge that in all circumstances the payment of Cashback to you is at our discretion and we may refuse to pay Cashback to you for any reason.

Discounts or Special Offers

Customers

Where a discount code or special offer is advertised on our Site or Social Media, we give no guarantee that it is valid and we shall not be held liable in any way whatsoever if the discount or voucher code fails to apply a discount. Furthermore, you acknowledge that use of a discount or voucher code from our Site and used in conjunction with a cashback offer may result in you failing to receive Cashback in accordance with the terms of the offer as stipulated on the Site from time to time.

Affiliate & Blog Advertising

We sometimes use affiliate links to products and services on retailer sites for which we can receive compensation if you click on those links or make purchases through them. From time to time we also publish advertorials (paid-for editorial content) and sponsored content on the site. When this is the case the content is clearly marked as sponsored or promoted, so you’ll always know which content is editorial and which is not. We have these to maintain website and running costs of the company.

Purchasing Products or Services

Customers

You may contact Professionals directly to enquire about their products and/or services and request an estimated cost for your project if applicable.

We are not party to the conversations you have or agreements you make with Professionals and shall not be held liable for any errors made by Professionals during your communication with them.

Professionals may have their own terms and conditions that you may be asked to accept when you purchase services directly from them. By purchasing products and/or services from them, you are entering into a legally binding agreement with the Professional to which HomeforLess shall not be party.

HomeInspire is not party to any transaction you enter into with a Professional and shall not bear any express or implied liabilities related to any services offered by Professionals through or outside the site. We do not possess, check or act as caretakers of any services that are sold by Professional at any time.

If you have any concerns about a Professional, please contact us at info@homeinspire.co.uk to report this and we shall carry out an investigation.

Payments

Customers

You may be paid your cashback via BACS. It is your responsibility to ensure your correct payout details are submitted. We shall not be responsible for any Cashback being sent to an incorrect destination where you have provided incorrect details. Such payments may not be recoverable and or may be subject to a recovery fee.

We shall not be liable for any delays in this regard or for any consequences of any delays which may occur.

We reserve the right to suspend Payable Cashback payments at any time without notice to you if we reasonably suspect fraudulent activity has taken place.

Professional

All invoices will be inclusive of VAT. You can either settle the invoice via Stripe through your dashboard, or directly to us using the bank details found at the bottom of our invoices. If you choose to pay via Stripe, it is your responsibility to ensure you follow their payment guidelines. 

We ask that any invoices are paid within 30 days of the original date of our invoice. As stated previously, if the cashback being claimed is against a product subject to a refund period, then please inform us upon receipt of the invoice. We recommend you pay commission after your refund period to avoid incorrect payouts, should the customer then choose to get a refund.

Disclaimer: In the event of customer refunds/returns/exchanges outside of your return window due to broken or faulty goods, we accept no liability for any incorrect payments made to us or the customer. Should there be any incorrect payments because of your products/services, we will not be liable to offer refunds.

Late Payments (Professionals)

If you haven’t settled our invoice within 30 days, and refund periods aren’t applicable, we reserve the right to charge interest for late payments. The law gives us the right to charge interest at the Bank of England base rate plus 8%. This is set in 6 month periods. Upon late payment charges, we shall issue this in writing, to your email address that you registered with on HomeforLess. If there is a reason as to why you haven’t paid, or been able to pay, you may reply to the late payment email.

Confidentiality

Personal information or business information that you supply to us, other than information that is in the public domain, will be treated confidentially and in line with our Privacy Policy. Confidential information will not be disclosed to any third party, including for the purposes of marketing, without your prior permission. We will only disclose your information if it is necessary for the performance of our services or where so required by law.

Site membership and usage

One customer account type is allowed per person. I.e. a person can’t have more than one customer account, but they can have a Customer and a Professional account. If a person has more than one company/business in the home/construction industry, they may have more than one Professional account, but must be registered under a separate email address to avoid any confusion with customer/payments, and to keep the two or more businesses completely separate. 

The legal owner of the email address used to sign up to the Site is deemed to be the account owner.

Any Cashback earned by a customer using the account will be credited to the account as if you had made the transaction yourself. A Professional account cannot submit for cashback. 

Any use of our Site is made based on the assumption that full authority has been obtained from all relevant parties. This may include but is not limited to employers, friends, family and businesses.

We do reserve the right to refuse membership and or terminate any account in accordance with these terms of use.

By joining the site, you confirm you are over 18.

Managing your account

Be sure to keep your account up to date with your current email address to make sure you don’t miss out on any important information about your account. If we don’t have a serviceable email address or if you mark our emails as spam, junk or abusive, we may terminate your account.

You can manage your account within your account profile. Here you can subscribe to or unsubscribe from any emails we may send, although please note that you cannot unsubscribe to service emails which we deem to be essential in order to use the Site. Please make yourself familiar with the email section in our Privacy Policy and feel free to amend your account settings to reflect what information you would like to receive from us.

You agree to ensure your username on the Site is not offensive nor used in any way which may represent any trademarks or brand names. If we detect any usernames contravening this provision we shall contact you and request that you update this. Failure by you to respond within 14 days may result in your account being terminated and any earnings forfeited.

User Submissions and Business Reviews

The HomeInspire site provides certain features which allows users the option to submit, post, and share content, which may include without limitation text, graphic and pictorial works, or any other content submitted by you and other users through the site (User Submissions).

HomeInspire does not guarantee any anonymity or confidentiality with respect to any User Submissions, and strongly recommends that you think carefully about what you upload to the site. You understand and agree that User Submissions may be made public without any additional notice to or consent by you and you should assume that any person (whether or not a user of HomeforLess platform), including any Professional, may read your User Submissions. HomeforLess is not responsible for the use or disclosure of any information that you disclose in connection with User Submissions, including any personal information.

User Submissions are displayed for information purposes only and reflect the opinions of the person making the submission. They are not controlled by, and shall not reflect the opinion of, HomeforLess. You understand that all User Submissions are the sole responsibility of the person from whom such User Submission originated. This means that you, and not HomeInspire, are entirely responsible for all User Submissions that you upload, post, e-mail, transmit, or otherwise make available through the site or our social media. You affirm, represent, and warrant that you own, or have the necessary licenses, rights, consents, and permissions to use the User Submissions you make.

We make no representations that we will publish or make available on the site any User Submissions, and we reserve the right, at our sole discretion, to refuse to allow any User Submissions on the site, or to edit or remove any User Submission at any time with or without notice.

You understand that when using the site, you may be exposed to User Submissions from a variety of sources and that HomeInspire does not endorse and is not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions.

We encourage our users to inform us of any User Submissions that are inaccurate, offensive, indecent, or objectionable so that we can take the necessary steps to remove them from our site. Although we will take reasonable steps to remove such User Submissions, you acknowledge and agree that HomeInspire shall bear no liability or responsibility whatsoever in any such User Submissions.

For all User Submissions, you grant HomeforLess a perpetual, irrevocable, royalty-free, transferable right and license to use, copy, modify, delete in its entirety, adapt, publish, translate, create derivative works from and/or sell and/or distribute such content and/or incorporate such content into any form, medium or technology without compensation to you.

We are the owner or licensee of all intellectual property rights in the site, including any databases that hold relevant information about the site, the site and its services. They are protected by copyright or trademark registration and you may only use any our services in line with these terms.

Conduct

HomeInspire strives to create a trustworthy and healthy environment for its users. We will not tolerate any behaviour that puts any of those aspects at risk and so by using our site, you agree not to:

  • Harass, threaten, disrupt or defraud users or Businesses or otherwise create or contribute to an unsafe, harassing, threatening or disruptive environment;

  • Make unsolicited offers, advertisements, proposals, or send junk mail or “spam” to users;

  • Misrepresent the source, identity, or content of information transmitted via the site, including deleting the copyright or other proprietary rights;

  • Send to Site users pornographic, threatening, embarrassing, hateful, racially or ethnically insulting, libellous, or otherwise inappropriate content.

Keeping your account details safe

Your password and any other piece of information as part of our security procedures, must be treated  as confidential. You must not disclose it to any third party.

Do not rely on information on this site

The content on our Site is provided for general information only. It is not intended to amount to advice on which you should rely. You must obtain professional or specialist advice before taking, or refraining from, any action on the basis of the content on our Site.

From time to time Professionals may increase or decrease the commission paid in which case the cashback offer illustrated on our site may be incorrect. Although we make reasonable efforts to update the information on our Site, we make no representations, warranties or guarantees, whether express or implied, that the content on our site is accurate, complete or up to date.

Termination and Modification

You agree that HomeforLess, at its sole discretion, may terminate, deactivate and / or suspend any advert or profile you may have displayed on our site.

We may also discontinue, modify or amend any aspect, feature or policy that is on our site. HomeInspire may, at its sole discretion and at any time, stop providing access to the site, or any part of it, with or without notice and HomeforLess will not be liable to you or any third party for any such termination of access.

Copyright infringing activities are illegal, and we reserve the right to terminate any access to our site or remove all content submitted by anyone who is found to be an infringer. Any suspected fraudulent, abusive, or illegal activity may also be referred to appropriate law enforcement bodies. These remedies are in addition to any other remedies that we may have at law.

Limits of Warranties and Liabilities

You are responsible for ensuring that any hardware you use to access our site functions correctly. You acknowledge and agree that the provision of all these requirements is your responsibility and is at your own cost.

We shall not limit or exclude our liability for:

  • death or personal injury;

  • fraud or fraudulent misrepresentation; or

  • any act, omission or matter, liability for which may not be excluded or limited under any Applicable Law.

We shall not be liable to you for any indirect, special or consequential loss or damage, including:

  • loss of profit;

  • loss of goodwill;

  • loss of savings; or

  • loss of contract.

We also exclude, but only as far as legally possible, all terms and warranties or promises implied by law or by statutes.

Although we try to ensure our digital products work seamlessly and without errors, we do not warrant that your use of our site will be uninterrupted. We are not responsible for any loss or damage you may suffer resulting from any interruptions, although we will use our best endeavours to rectify any issues you encounter as soon as possible.

Any duty of care owed to you by us is owed to you alone and no duty of care is owed to any third party and we do not assume any responsibility to any third party in respect of the performance of our duties to you.

Links to our site or other sites

You are allowed to make a link to our site’s homepage from your website if the content on your site meets the standards of our Acceptable Use Policy and provided you do not suggest any endorsement by us or association with us unless we provide agreement in writing. We reserve the right to end this permission at any time.

Links from our site to other sites are only for information. We do not accept any responsibility for other sites, the accuracy of their content or any loss you may suffer from using and relying on them.

Events outside our control

We will not be liable for any failure or delay to perform any of our obligations under a contract for a digital product that is caused by events outside our reasonable control.

Computer Offences

If you do anything which is a criminal offence under the Computer Misuse Act 1990 (such as for example introducing viruses, worms, Trojans and other technologically harmful or damaging material) your right to use the site will end immediately, we will report you to the relevant authorities and provide them with details of your identity.

You must not try to obtain access to our server or any connected database or make any ‘attack’ on the site.

Partnership or Agency

Professionals

Nothing in this Agreement shall be construed to create a partnership, joint venture or agency relationship between the parties unless otherwise agreed by HomeInspire and the other party or parties involved. Should a partnership, joint venture or agency relationship be created between parties, a separate contract shall be drawn up by either party for both to agree to terms and sign.

Applicable Law

Any dispute arising from these terms shall be governed by and construed in accordance with the law of England and Wales and you irrevocably agree that the courts of England and Wales shall have exclusive jurisdiction to settle any arising dispute.
If any part of these terms and conditions is held to be invalid or unenforceable, the remaining terms and conditions will continue in full force and effect.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.
